1. General Terms
By accessing and using thepoparc.com and purchasing our products, you agree to be bound by these Terms of Use. Please read them carefully before making any purchase.
THEPOPARC ("we", "us", "our") reserves the right to update these terms at any time without prior notice.
2. Product Description & Pre-Order Notice
2.1 All products currently listed on thepoparc.com are pre-order items. Production is underway and estimated completion is June 15, 2026.
2.2 Product images on our website represent production prototypes. The final product may have minor variations in:
- Color tone and finish
- Surface texture
- Minor dimensional adjustments
2.3 Core design, functionality, materials, and overall aesthetic of the final product will remain substantially identical to prototype images shown.
2.4 By placing an order you confirm that you have read, understood and accepted that product images represent prototypes and minor variations may exist in the final product.
3. Purchase Confirmation & Agreement
3.1 By completing checkout and ticking the confirmation checkbox you explicitly confirm:

3.3 Your order confirmation email serves as proof of your agreement to these terms and will be referenced in any dispute resolution process.
4. Payment Terms
4.1 All prices are listed in USD.
4.2 Full payment is required at time of order to secure your pre-order slot.
4.3 By submitting payment you authorize THEPOPARC to charge your payment method for the full order amount.
4.4 Your payment secures your place in the production queue. Production slots are limited and allocated on a first-come, first-served basis.
5. Refund & Cancellation Policy
5.1 All sales are final once production has begun.
5.2 Cancellations are accepted within 24 hours of purchase only, provided production of your order has not yet commenced.
5.3 Once payment has been completed, the order becomes non-refundable and cannot be canceled.
5.4 THEPOPARC will not issue refunds for:
- Change of mind
- Delayed shipping within stated timeframes
- Minor product variations from prototype images
- Inability to use the product with specific watch models not listed as compatible
- Incorrect size ordered by customer
5.5 Refunds will only be considered in the following circumstances:
- Product arrives significantly damaged beyond reasonable use
- Product is entirely different from what was ordered
- Order was never fulfilled and no shipping update provided within 90 days of estimated ship date
6. Chargeback Policy
6.1 By completing your purchase you agree that initiating a chargeback or payment dispute with your bank or credit card company without first contacting THEPOPARC constitutes a violation of these Terms of Use.
6.2 Before initiating any dispute you agree to:

- All order confirmations
- Customer agreement to these terms
- Shipping and tracking information
- Product delivery confirmation
- All customer communications
6.4 In the event of an unauthorized or fraudulent chargeback, THEPOPARC reserves the right to submit all evidence to payment processor, pursue recovery of funds through available legal channels, and report fraudulent activity to relevant authorities.
6.5 Initiating a chargeback for a delivered order that matches its description constitutes fraudulent misrepresentation and will be disputed with full documentation provided to your financial institution.
7. Shipping & Delivery
7.1 Estimated shipping date: June 2026 (subject to production completion).
7.2 Shipping timelines are estimates and not guarantees. Delays may occur due to manufacturing adjustments, global logistics conditions, or customs clearance.
7.3 THEPOPARC will provide tracking information for all orders once shipped.
7.4 Customer is responsible for providing accurate shipping address, any applicable import duties or taxes, and monitoring tracking information.
7.5 THEPOPARC is not responsible for delays caused by customs, shipping carriers, or incorrect addresses provided by customer.
7.6 Customer is solely responsible for compliance with all import regulations in the destination country, including customs clearance procedures, payment of any applicable duties, taxes, fees, or other governmental charges. THEPOPARC shall not be responsible for any delays, costs, penalties, confiscations, or other consequences arising from the customer's failure to comply with such requirements.
8. Product Compatibility
8.1 Our wrist adapter is designed for the AP x Swatch RoyalPop collection.
8.2 THEPOPARC does not guarantee compatibility with future versions or releases of the RoyalPop, modified or third-party versions of the watch module, or watch modules that have been altered from original specifications.
8.3 Customer accepts full responsibility for verifying compatibility before purchase.
9. Intellectual Property
9.1 THEPOPARC is an independent brand and is not affiliated with, endorsed by, or officially connected to Audemars Piguet or Swatch Group in any way.
9.2 All THEPOPARC branding, designs, and content are the exclusive property of THEPOPARC.
10. Limitation of Liability
10.1 THEPOPARC's total liability for any claim shall not exceed the amount paid for the specific order in question.
10.2 THEPOPARC is not liable for indirect or consequential damages, loss of profit or revenue, personal injury from product misuse, or damage to the watch module during installation.
11. Dispute Resolution
11.1 In the event of any dispute, both parties agree to first attempt resolution through direct communication.

11.3 Response time: within 5 business days.
11.4 If resolution cannot be reached through direct communication, disputes shall be resolved through binding arbitration.
